We purchased this property to build a small house with a large open space to use as a gathering place for Families: Faith, Fun & Fellowship within walking distance to Our Lady of Guadalupe.
It is a .63 Acre property located in downtown Immokalee. It is zoned C4 & RMF offering flexibility for Business and/or Residential use.
The property is set back from Main Street and has a paved driveway connecting the two. This access was used for ingress/egress for since ’77. We have continued to use the same.
While this access was not recorded by the original owners in 1977 but was acceptable by them.
However, a Documented Easement needs to be prepared and registered with Collier County for an address & permits.
We were permitted by the County, in writing for a SE access to Boston Ave that was (after the purchase) rescinded by the County without an apology or explanation.
So we continued to ingress and egress through the original path which was used since 1977.
The Servient Owner (Blockers) said that was OK to do so, however ‘refuses’ to put it in WRITING.
The State Law: 704.01 guarantees us access to the closest public road and the servient owner should oblige.
So our choices are to:
1: Sell this property ‘AS IS’ with this Disclosure (and buy elsewhere else instead).Our Choice.
OR
2: Take the Servient Owner (Blocker) to Court to resolve this.
Blocker suggests we use a SW path instead; which does not reasonable nor beneficial to us.
This property ‘land only’ is being sold ‘as is’.
